1. Acceptance of These Terms 

Welcome to The Ivy Lounge Wellness. These Terms & Conditions (“Terms”) govern your access to and use of services provided by The Ivy Lounge LLC, doing business as The Ivy Lounge Wellness (“Ivy Lounge,” “we,” “us,” or “our”), including services delivered at our Irving, Texas location, through our website at ivyloungewellness.com, through our online booking system (Jane App), and through any related communications or programs. 

By booking an appointment, purchasing a service, signing up for a membership, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use our services. 

 

2. Medical Disclaimer & Scope of Service 

Wellness services, not primary medical care. Ivy Lounge provides elective wellness services including IV therapy, intramuscular vitamin injections, NAD+ infusions, and related therapies. Services are delivered by licensed clinical personnel, which may include nurse practitioners, registered nurses, licensed vocational nurses, or other authorized personnel, under applicable protocols, standing orders, and Medical Director oversight. We are not a primary care provider, urgent care center, or emergency facility. 

Not medical advice. Information on our website, social media, intake forms, or in conversation with staff is for educational purposes only and is not intended to diagnose, treat, cure, or prevent any disease. Statements about our services have not been evaluated by the FDA. Always consult your primary care physician before starting any new therapy, especially if you have a medical condition, are pregnant or nursing, or are taking medications. 

Limited clinical relationship. Receiving services from Ivy Lounge Wellness may create a limited treatment relationship for the specific wellness service provided during that visit. Ivy Lounge Wellness is not your primary care provider, urgent care provider, or emergency care provider, and our Medical Director does not replace your personal physician or specialist. 

Emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not rely on Ivy Lounge or its staff for emergency medical care. 

 

3. Eligibility & Informed Consent 

  • You must be at least 18 years old to book and receive services on your own behalf. Minors aged 13-17 may receive treatment only with documented written consent from a parent or legal guardian and that adult’s presence throughout the appointment. 
  • You must complete our intake form truthfully and disclose all relevant medical history, allergies, medications, and pregnancy or nursing status. Failure to disclose may result in refusal or modification of treatment. 
  • Our clinical staff and Medical Director reserve the right to refuse, modify, or discontinue any service at their professional discretion if they determine it is not safe or appropriate for you. 
  • You must sign an informed consent form before each treatment type. Specific therapies (such as NAD+, high-dose Vitamin C, Ketorolac, and Glutathione) require additional review for contraindications. 

 

4. Booking, Cancellation & No-Show Policy 

4.1 How to Book 

Appointments are booked through our online scheduler at ivyloungewellness.janeapp.com, by phone at +1 469-668-3133, or in person. Booking is confirmed when you receive a confirmation email or text from Jane App. 

 

4.2 Cancellation Window 

Cancellations or reschedules must be made at least 24 hours before your scheduled appointment time. Late cancellations and no-shows incur the following fees:

Cancellation fees are charged to the card on file. We may waive fees at our discretion in cases of documented medical emergency or other extenuating circumstances. 

 

4.3 Late Arrival 

If you arrive more than 15 minutes late to your appointment, we may need to shorten your treatment, reschedule, or treat the appointment as a no-show, depending on the schedule. 

 

5. Payment Terms 

  • All services and memberships are cash-pay. We do not bill health insurance. You may use HSA or FSA funds where eligible, but it is your responsibility to confirm eligibility with your plan administrator. 
  • Payment is due at the time of service for one-off appointments. Memberships are charged via auto-renewal as described in Section 8. 
  • We accept major credit and debit cards, processed through Jane Payments (Stripe). A valid card must be kept on file for membership accounts. 
  • Prices are subject to change. Members on active recurring billing are protected from price increases through their then-current billing cycle and will be given at least 30 days’ notice of any rate change. 
  • All sales are final. Refunds are issued at our sole discretion and only under the conditions described in these Terms. 
  • By placing a card on file, you authorize Ivy Lounge Wellness and its payment processor to charge that card for scheduled services, approved purchases, membership fees, late cancellation fees, no-show fees, and other amounts owed under these Terms or a signed authorization. 

 

6. Gift Cards, Packages & Promotions 

  • Gift cards are non-refundable, non-redeemable for cash (except where required by law), and do not expire. 
  • Service packages (bundled drips, multi-session purchases) expire 12 months from the date of purchase unless otherwise stated. Unused sessions after expiration are forfeited. 
  • Promotional discounts cannot be combined unless explicitly stated. One promotion per transaction. 
  • Promotions and gift cards have no cash value, cannot be transferred for cash, and may be subject to additional terms stated at the time of purchase. 
  • Gift cards do not expire and are treated separately from promotional credits, service packages, and membership credits. Promotional credits, discounted packages, and membership credits may expire as stated at purchase or in the applicable membership terms. 

 

7. Client Conduct 

We are committed to a safe, professional, and respectful environment. We reserve the right to refuse service or terminate a membership, without refund, if a client: 

  • Engages in abusive, threatening, harassing, or discriminatory behavior toward staff or other clients. 
  • Arrives under the influence of alcohol or recreational drugs that may interact with treatment. 
  • Provides false or misleading information on intake forms. 
  • Repeatedly violates the cancellation, no-show, or payment policies. 
  • Damages property or otherwise disrupts the clinic environment. 

 

8. Membership Terms 

The following terms apply to all Ivy Lounge Wellness membership tiers (Essentials, Vitality, NAD+ Protocol, and Ivy Elite). These terms are incorporated into your Membership Agreement upon signup. 

 

8.1 Billing & Auto-Renewal 
  • All memberships auto-renew monthly via Jane Payments on the calendar date of original signup. 
  • By enrolling in a membership plan, you authorize recurring monthly charges until cancellation becomes effective under these Terms. The amount, billing date, cancellation process, and any final billing cycle will be disclosed before enrollment. 
  • Membership fees are non-refundable once the billing cycle has been charged. 
  • Members may upgrade tier at any time — prorated for the current cycle. 
  • Tier downgrades take effect at the start of the next billing cycle. 
  • It is your responsibility to keep a valid payment method on file. Failed payments may result in suspension of benefits until resolved. 

 

8.2 Credits — Usage & Rollover 
  • Credits load in full at the start of each billing cycle. 
  • Unused credits roll over for 30 days (until the end of the following billing cycle), then expire. 
  • Credits are non-transferable and non-refundable. 
  • Credits expire on cancellation effective date — no payout is issued for unused balance. 
  • Only the named member may redeem credits. Exception: the Ivy Elite quarterly guest pass (see Section 8.6). 

 

8.3 Cancellation 
  • Cancel anytime — 30-day written notice required (by email to info@ivyloungewellness.com or via the in-app message function). 
  • No minimum commitment period. 
  • One final billing cycle will process after the cancellation notice. The member retains full access and credits through that final cycle. 
  • Membership terminates at the end of the final billing cycle. No further charges. 

 

8.4 Freeze / Pause Policy 
  • Members may freeze membership for up to 60 days per calendar year, total. 
  • Freeze requests must be submitted in writing at least 5 days before the next billing date. 
  • Documentation is required for medical, pregnancy, or extended travel freezes (e.g., doctor’s note, travel itinerary). 
  • Frozen accounts: no billing, no new credits issued, no service access. Existing credits pause and resume on unfreeze. 
  • Maximum continuous freeze period: 30 days. Members may take two 30-day freezes per year, or one continuous 60-day stretch with documentation. 

 

8.5 Founding Members Program 
  • The first 50 members across all tiers receive $10/month off, for the life of their membership. 
  • The Founders’ rate applies as long as membership remains active and uncancelled. 
  • If a founding member cancels and re-signs later, they lose the Founders’ rate and pay standard pricing. 
  • The Founders’ rate does not stack with promotional discounts. 
  • For tier upgrades, the Founders’ discount continues at the new tier’s discounted rate. 

 

8.6 Ivy Elite Guest Pass 
  • Each Ivy Elite member receives one (1) guest pass per quarter (Jan-Mar, Apr-Jun, Jul-Sep, Oct-Dec). 
  • A guest pass entitles a first-time, non-member guest to one Essentials-tier drip (Quick Sip) at no charge. 
  • Booking process: the member books the appointment in Jane on the guest’s behalf, includes the guest’s full name, date of birth, and contact details in the appointment note, and notes “Q[X] Guest Pass — [Member Name]” in the booking. 
  • The guest must complete standard intake on the first visit. The guest pass expires at the end of the quarter — it is not bankable. 
  • Guest pass is valid for Quick Sip only — guests may upgrade by paying the difference to a higher-tier drip at non-member retail pricing. 
  • One guest pass per guest, per calendar year — passes cannot be used to give the same person repeated free drips. 

 

8.7 NAD+ Protocol — Additional Terms 
  • NAD+ Protocol membership is intended as a 4-week structured program. Members should schedule sessions at consistent weekly intervals. 
  • Members may upgrade their NAD+ dose tier (Standard 150 mg, Premium 200 mg, Max 250 mg) by paying the difference between the Starter retail price and the upgraded tier retail price. 
  • Higher dose upgrades require documented prior tolerance on file. Max Protocol (250 mg) additionally requires Medical Director approval. 
  • Medical Director intake consult is included in month 1; additional consults are billed at the standard rate. 
  • Baseline and 90-day biomarker review uses a self-reported intake form — no lab work is included. 

 

9. Website Use & Intellectual Property 

Our website, including all content, logos, images, text, graphics, and design, is owned by The Ivy Lounge LLC or licensed to us, and is protected by copyright, trademark, and other intellectual property laws. 

You may use our website for personal, non-commercial purposes only. You may not: 

  • Copy, reproduce, modify, distribute, or republish any content without our written permission. 
  • Use our trademarks, logos, or branding without prior written authorization. 
  • Use automated means (bots, scrapers, crawlers) to access the site. 
  • Interfere with the security or proper functioning of the site. 
  • Use the site for any unlawful, harmful, or fraudulent purpose. 

 

10. Reviews, Testimonials & User Content 

If you provide a review, testimonial, social media post, or other content about Ivy Lounge, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content for marketing and promotional purposes, with attribution where applicable. You represent that the content is your own and does not violate any third-party rights. 

We may, with your explicit written consent, use your name, photo, or before/after images in marketing materials. You may withdraw that consent at any time by writing to us, and we will stop using the materials prospectively. 

 

11. Disclaimers of Warranty 

Services are provided “as is.” To the fullest extent permitted by law, Ivy Lounge disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that our services will achieve any particular health, cosmetic, or wellness outcome. 

Individual results from IV therapy, NAD+, vitamin injections, and other wellness services vary widely and depend on many factors outside our control, including your underlying health, hydration, lifestyle, and adherence to recommendations. We do not guarantee any specific result. 

 

12. Limitation of Liability 

To the fullest extent permitted by Texas law: 

  • Ivy Lounge, its owners, employees, contractors, and Medical Director shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our services or website. 
  • Our total cumulative liability to you for any claim arising from these Terms or your use of our services shall not exceed the total amount you have paid to Ivy Lounge in the twelve (12) months preceding the event giving rise to the claim. 
  • Nothing in these Terms limits liability that cannot lawfully be limited under Texas law, including liability for gross negligence, willful misconduct, or personal injury caused by our negligence. 

 

13. Indemnification 

You agree to indemnify, defend, and hold harmless The Ivy Lounge LLC, its officers, employees, contractors, and Medical Director from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising from (a) your breach of these Terms, (b) your failure to disclose accurate health information, (c) your violation of any law or third-party right, or (d) your misuse of our services or website. 

 

14. Governing Law & Dispute Resolution 

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. 

Informal resolution first. Before filing any formal claim, you agree to contact us at info@ivyloungewellness.com and give us 30 days to attempt to resolve the dispute informally and in good faith. 

Binding arbitration. Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Dallas County, Texas, in English. The arbitrator’s decision shall be final and binding. Each party will bear its own costs and attorney’s fees, except as the arbitrator may award. 

Class action waiver. You and Ivy Lounge agree that any dispute will be resolved on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to a jury trial. 

Exception. Either party may bring an individual claim in small-claims court in Dallas County, Texas, in lieu of arbitration, if the claim qualifies. 

 

15. General Provisions 

  • Entire agreement. These Terms, our Privacy Policy, any signed Informed Consent forms, and any signed Membership Agreement together constitute the entire agreement between you and Ivy Lounge regarding our services. 
  • Changes to Terms. We may update these Terms from time to time. We will post the updated version on our website and update the “Last Updated” date. Material changes will be communicated to active members by email at least 30 days before they take effect. Continued use of our services after the effective date constitutes acceptance. 
  • Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. 
  • No waiver. Our failure to enforce any provision does not waive our right to enforce it later. 
  • Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations to any successor entity. 
  • Headings. Section headings are for convenience only and do not affect interpretation.
